WHAT THE FLORIDA PREBORN LIFE PROTECTION ACT WOULD DO:
- Establishes a comprehensive ban on nearly all abortions throughout Florida, starting from fertilization.
- Includes a singular exception permitting an abortion only if a physician determines it is necessary to save the mother's life.
- Mandates life-preserving care: In medical emergencies, doctors must strive to preserve the mother’s health while maximizing the survival chances for the preborn.
- Upgrades penalties: Illegal abortion procedures are first-degree felonies and attempts are third-degree felonies to ensure strict enforcement.
- Sets civil fines: A minimum civil fine of $100,000 per violation, empowering the Attorney General to pursue these penalties.
- Credential revocation: Licensing authorities will permanently strip professional credentials from any provider found in breach of this legislation.
- Regulates chemical agents: Mifepristone and Misoprostol are listed as Schedule IV substances, prohibiting their distribution for pregnancy terminations.
- Preserves ethical access: Access to these medications is maintained for verified needs, including miscarriage management and treating Cushing’s syndrome.
WHAT THE FLORIDA PREBORN LIFE PROTECTION ACT DOES NOT DO:
To prevent misconceptions and ensure legal clarity, it is essential to understand the specific boundaries of this legislation. The Florida Preborn Life Protection Act is meticulously drafted to target abortion providers while protecting the rights and health of women. Specifically, this Act:
- Does NOT prosecute mothers: The Act explicitly prohibits the criminal prosecution or civil liability of any mother regarding the death of her preborn child.
- Does NOT restrict contraception: Access to standard and emergency contraception (which prevents fertilization) remains fully legal and unaffected.
- Does NOT impede miscarriage care: Ethical medical treatment for miscarriages and spontaneous pregnancy losses is fully protected.
- Does NOT limit treatment for chronic conditions: Patients retain access to necessary medications, such as those for Cushing’s Syndrome, even if they contain regulated substances.
- Does NOT prevent life-saving care: Physicians are empowered to act decisively when a mother’s physical life is at imminent risk.
